Tianyancha app shows Shanghai miHoYo Technology Co., Ltd. against Guangzhou Information Technology Co., Ltd.
It is worth noting that Guangzhou Information Technology Co., Ltd. is affiliated with Guangzhou 37Games Network Technology Co., Ltd. and another entity. The content of the lawsuit revolves around miHoYo accusing it of promoting a plagiarized product Genshin Impact.
The parties involved took each other to court because of ownership rights and disputes over violations of legal documents published recently.
The document shows that plaintiff miHoYo alleges that the West Wind Knights game in advertising on the WeChat public account operated jointly by 37Games Network and Jiaqu Network infringes the image of Genshin Impact – the game company’s hit game from Shanghai.
The defendant argued that the use of that image did not constitute an act of unfair competition and that the plaintiff’s claim was too high. Defendant alleges that he is neither an operator nor an advertiser and has no knowledge of 37Games’ promotional conduct in relation to that product. Therefore, this conduct does not constitute a general offence.
The court held that the defendant published photos that were essentially identical to the plaintiff’s work on his public account. This violated the right to disseminate information about the plaintiff’s work online. At the same time, the defendant’s violation caused confusion among the players involved in Genshin Impact, creating unfair competition. In the end, the court ordered the defendant to pay the plaintiff miHoYo 30,000 yuan.
Guangzhou Volcanic Lake Information Technology Co., Ltd is a wholly owned subsidiary of 37Games Guangzhou, which is held by Sanqi Interactive.
So far, many products have been released with gameplay and images close to Genhsin Impact with the aim of replacing miHoYo’s game.
